General conditions for claims with airlines
This document determines the terms and General Contracting Conditions of the service of PassengersRights.eu, service owned by Pablo García Torres DNI 78522567S with address at Avda Touroperador Tui nº5, 35100 Maspalomas (Las Palmas), Spain.
1. Purpose of the contract and claim procedure
PassengersRights.eu will carry out the claim in the event of cancellation, delay, denial of boarding, no-show and baggage, both in preliminary and judicial proceedings, before the airlines and, where appropriate, may denounce these breaches before AENA and AESA.
- Preliminary actions: Claim prior to the judicial process to obtain payment without having to go to trial.
- Judicial actions: Legal claim before the competent commercial court.
2. Fees and payment method
We will only charge in case your claim is successful. The fees that PassengersRights.eu receives in case of success of the claim are:
25% of the amount obtained + IGIC (7%).
PassengersRights.eu will advance all expenses for you, so you do not have to make any down payment.
In case of success, but if the amount is collected via court, we will pass you an additional 150 € + IGIC for administrative expenses.
In exceptional cases (claims over 2000 €, or if it is necessary to attend court and you can’t), there might be a need for a representative with a cost of 25 € + IGIC, or a notary for 350 € + IGIC.
3. Obligations of the parties
PassengersRights.eu commits to:
- Act according to legal and ethical codes.
- Keep you informed of changes by email.
- Seek pre-judicial agreements with airlines.
- Close agreements when the offer is at least 90% of the claimed amount.
- Request your payment data to transfer your compensation once received (minus fees).
The client commits to:
- Sign the authorization personally or on behalf of a represented person.
- Not claim independently or via third parties once authorized PassengersRights.eu.
- Inform us of any change in email or contact data.
- Attend hearings or delegate legal representation if needed.
- Provide accurate documents.
- Inform us if compensation is received directly from the airline.
If you fail to attend hearings, don’t inform us of payments, or reach private agreements with the airline, fees and costs will be charged.
4. Resolution of the Contract
You can cancel the contract anytime by writing to info@passengersrights.eu. If the claim has already been filed before court, our fees and expenses will still apply.
PassengersRights.eu may also cancel the contract if you initiate a duplicate claim without informing us.
Spanish law applies. If the client is not considered a consumer, jurisdiction will belong to the Courts of Las Palmas de Gran Canaria.
5. Nullity
If any clause is declared null or invalid, the rest remain valid. Non-enforcement of a clause doesn’t mean its waiver.
